Terms for using AskOut, including AskOut Premium.

1. Agreement to These Terms

These Terms of Use ("Terms") govern your access to and use of AskOut's websites, mobile applications, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

We may refer to AskOut as "we," "us," or "our." You are the "user" or "you."

2. What AskOut Is

AskOut is a social activity platform. It allows users to create, publish, and manage plans (such as sports, coffee, trips, and events), discover plans posted by others, participate in plans, and engage in activity-based interactions only—centered on shared plans and events.

The Service facilitates coordination and participation in activities. It does not exist to introduce users for private personal or intimate purposes, or to operate as a service for pairing individuals outside the context of posted plans and events.

3. Eligibility and Accounts

3.1 Age

You must be at least 18 years old to use the Service. By registering, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3.2 Accurate information

You agree to provide accurate, current, and complete profile and account information and to update it as needed. You must not impersonate others or misrepresent your identity, affiliation, or eligibility.

3.3 Account security

You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use.

3.4 Sign-in methods

You may create and access an account using WhatsApp phone verification, Google Sign-In, or Sign in with Apple (where available in the app), as we offer from time to time. You must use your own credentials and must not impersonate others or use accounts you are not authorized to use.

If you sign in with Google or Apple, you may use AskOut without providing a phone number, subject to feature availability and our policies. We may link or merge accounts when we reasonably believe they belong to the same person (for example, when the same verified email is used). You must not create duplicate accounts to evade enforcement, limits, or restrictions.

Your use of Google Sign-In or Sign in with Apple is also subject to those providers’ terms and policies. We verify sign-in through ID tokens they issue; we do not receive your Google or Apple account password.

4. User Conduct

You agree to use the Service lawfully and respectfully. Interactions must remain respectful and activity-focused.

You must not:

  • Harass, abuse, threaten, stalk, or discriminate against users or third parties
  • Use the Service for solicitation, escorting, or any service that mirrors or replaces personal introduction or companionship-for-hire businesses
  • Use the platform primarily to arrange private one-on-one encounters unrelated to genuine plans or events visible to participants
  • Post, send, or upload illegal content; content that infringes copyright, trademark, or other intellectual property; or non-consensual intimate imagery
  • Share sexually explicit or obscene material where prohibited by our policies or applicable law
  • Spam, scrape, harvest data, or send unsolicited bulk messages
  • Introduce malware, interfere with the Service, or attempt unauthorized access
  • Circumvent technical limits, including those on how users may interact with plan participants
  • Use multiple accounts to evade enforcement or mislead others

We may update acceptable-use expectations in-app or in supplemental policies. Continued use after notice constitutes agreement where permitted by law.

5. Platform Rules

  • Plan-based interaction: You may interact with plan participants in connection with plans you create or join, as implemented in the Service. Messaging and social features are not a general-purpose network for contacting every user.
  • No guarantee of outcomes: We do not guarantee that any plan will occur, that others will attend, or that participants will behave in any particular way. Plans are user-driven; we provide software only.
  • No background checks: AskOut does not conduct criminal or other background checks on users. Information on profiles is user-provided and unverified unless we state otherwise for a specific feature.
  • Your safety and decisions: You are solely responsible for your choices when coordinating or attending in-person activities, including where, when, and with whom you meet to participate in plans. Use good judgment and follow applicable laws and public health guidance.

6. User-Generated Content

6.1 Your ownership

You retain ownership of content you upload (such as text, images, and other media), subject to the license below.

6.2 License to AskOut

You grant AskOut a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, adapt, publish, display, and distribute your content solely to operate, improve, promote, and secure the Service and to enforce these Terms.

6.3 Your responsibility

You are solely responsible for content you upload, including images and text. You represent that you have all rights necessary to grant the license above and that your content does not violate law or third-party rights.

6.4 Copyright and infringement

We respect intellectual property rights. If you believe content on the Service infringes your rights, contact us at legal@askout.com with sufficient detail to assess the claim (for example, identification of the work, location of the material, and a good-faith statement). We may remove or disable access to allegedly infringing material in line with applicable law and our processes.

7. Our Role; Disclaimers

  • Facilitator, not organizer: AskOut provides software that helps users post and join plans. We are not the organizer, sponsor, employer, or agent of users or of offline activities. Users organize and attend activities at their own risk.
  • User conduct and offline conduct: We are not responsible for the actions of users or third parties, including at in-person events. We do not control whether users attend, how they behave, or what happens outside the Service.
  • No endorsement: Display of a plan or user does not mean we endorse that activity or person.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASKOUT AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE OR ANY CONDUCT OR CONTENT OF OTHER USERS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) IF NO FEES APPLIED, ONE HUNDRED INDIAN RUPEES (INR 100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MINIMUM PERMITTED BY LAW.

9. Indemnity

You will defend, indemnify, and hold harmless AskOut and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of third-party rights.

10. Communication Rules

  • Messaging and similar features are for activity-based interactions only, among participants in the contexts the Service provides (for example, plans you join).
  • Unsolicited advertising, spam, or bulk outreach outside permitted channels is prohibited.
  • We may use automated tools and human review to monitor, filter, or moderate content for safety, fraud prevention, and compliance, subject to applicable law and our Privacy Policy.

11. AskOut Premium (Paid Subscriptions)

AskOut Premium is an optional auto-renewing subscription sold in the mobile app. The core Service (browsing plans, posting plans, chatting, and joining within free limits) does not require a subscription. Price, duration, and local currency are shown in the purchase flow before you confirm. Those on-screen terms control if they differ from this summary.

11.1 What Premium includes

AskOut Premium currently includes unlimited plan joins, advanced discover filters, and one plan boost every week, as described in the app. We may change benefits with notice where required. Some users (for example, women) may receive equivalent privileges without paying; that does not create a charge unless you buy a subscription.

11.2 Plans, billing, and auto-renewal

  • Available plans typically include weekly, monthly, and three-month options. The exact price for your store and territory is displayed at checkout.
  • Payment is charged to your Apple ID or Google Play account when you confirm purchase.
  • The subscription renews automatically at the end of each billing period until you cancel. You can cancel anytime; cancellation takes effect at the end of the current paid period (you keep Premium until then), unless the store’s rules or local law require otherwise.
  • On Apple devices, Apple may charge the renewal within 24 hours before the period ends if you have not cancelled.

11.3 How to cancel or restore

  • Apple: Settings → [your name] → Subscriptions, or the App Store subscription management page.
  • Google Play: Play Store → Payments & subscriptions → Subscriptions, or the in-app Restore / account settings we provide.
  • You can restore a previous purchase in the app (Settings or the Premium paywall → Restore).

11.4 Refunds

Refunds, if any, are handled by Apple or Google under their store policies, and by applicable consumer law. AskOut does not process card numbers; the stores are the merchant of record for in-app subscriptions.

12. Privacy

Our Privacy Policy describes how we collect, use, and share personal information. By using the Service, you acknowledge that we process data as described there. These Terms do not repeat the Privacy Policy; the Privacy Policy governs data practices.

13. Third-Party Services and Links

The Service may contain links to third-party sites or integrations. Sign-in options include Google Sign-In, Sign in with Apple, and WhatsApp (for one-time password delivery via Meta). Those services are operated by third parties under their own terms and privacy policies. The mobile app may also display third-party advertisements (including through Google AdMob). We do not control and are not responsible for third-party content, ads, terms, or practices. Your use of third-party services is at your own risk. How sign-in and advertising partners process data is described in our Privacy Policy.

14. Termination and Enforcement

We may suspend, restrict, or terminate your account, remove or restrict content, or block access to the Service, with or without prior notice, if we believe you violated these Terms, pose a safety or legal risk, or need to do so to protect the Service or others.

You may stop using the Service at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution) will survive termination.

15. Changes to These Terms

We may modify these Terms from time to time. We will post the updated Terms and revise the "Last Updated" date. If changes are material, we will provide additional notice as required by law (for example, in-app notice). Your continued use after the effective date of changes constitutes acceptance unless applicable law requires a different process.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-law principles that would require another jurisdiction's laws to apply.

Subject to mandatory consumer protections in your place of residence, you agree that the courts of India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where applicable law requires a different venue. You and AskOut will first attempt to resolve disputes informally by contacting legal@askout.com before initiating legal action.

17. General

Entire agreement. These Terms and policies referenced herein are the entire agreement between you and AskOut regarding the Service.

Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.

Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.

Waiver. Failure to enforce a provision is not a waiver of our rights.
